Expropriation Committee

First : Formation of the committee and its authorities

The valuation committee is formed based on the provisions of the article (5) of the law No. 33 / 1964 with regard to expropriation and temporary seizure for public welfare and its amendments that provides : A committee shall be formed in the Expropriation of Public Welfare Department, namely ((Expropriation Committee)) under the chairmanship of Minster of Finance and three members from municipal council elected for this for their term of their membership, manager Dept of expropriation, director general of the municipality, assistant undersecretary of state properties, representative of ministry of planning and a representative of the agency requesting the expropriation.

Its powers and authorities :

(( This committee is authorized to issue its decision about confirmation of Public benefit that entails the expropriation… Article (5). The Expropriation committee shall study public benefit project to issue the decision of public benefit or reject it within one month from the date it was referred to it.

The committee is entitled to seek the wanted clarifications, data or details with regard to the properties to be expropriated.

It is further entitled, in this regard, to depute a representative on its behalf to enter the properties and the lands to be expropriated in order to carry out the technical and cadastral works and can call any concerned person to discuss with him … article (8) amended.

Validity of its meetings :

The meeting of the committee will not be valid without attendance and majority of the members who form the committee and the decisions will be issued with the absolute majority of the attendees, and when the votes are equal, the side taken by the Chairman will be preferred and abstention will be considered a refusal to the decision … article (8) amended.

Second : Procedures to arrange the applications in order to present them to the committee :

  1. Scheduling the applications based on the priority applicable in the annual expropriation budget or as decided by the Expropriation Committee, and the schedules shall contain the names of the owners, descriptive details of the properties and format numbers of their expropriation (Name of the owners – format number – plant number –plot number – area – document number – kind of usage – purpose of expropriation).
  2. Preparation of an estimated statement of the applications presented in the light of the balance of the annual budget for land expropriation in collaboration with the Cadastral Section and Valuation secretary based on the provisions of the article No. 10 of the law, which provides : (( No decision of expropriation shall be issued but in the limits of the annual budget or additional appropriations in this regard )).
  3. Preparation of general plans to which the properties presented to the committee are subjected.
  4. The Minister of Finance (Chairman of the committee) shall fix the meeting date and present the initial statement about the properties to be presented as well as their initial estimates.
  5. Preparation of an invitation to the committee members with its agenda.
  6. The committee shall meet on the fixed date and then take its decisions estimating the public interest of each application or rejecting the presented applications (article 8) amended.
  7. A minute of the meeting of the Expropriation committee will be prepared and signed by the Chairman as well as the members.
  8. The respected Minister of Finance shall issue a decision of expropriating the properties about which a decision was issued confirming the public benefit (article 9) amended.
  9. This decision shall be published in the official gazette and the daily gazette and the decisions of expropriation will be displayed at the gate of the area mayor, and the stakeholder shall be notified to apply to prove their entitlements within a month from the date of publication in the official gazette (article 11).
  10. The Ministry of Justice (Real  Estate Registration) will be informed of the decisions of expropriation published in the official gazette with the supported the plans (article 21).
  11. The decisions of expropriation will be circulated to the concerned agencies (Ministry of Finance – State Properties – Kuwait Municipality Regulation – Cadastral Section – concerned municipality branches).
  12. The expropriation decisions will be referred to the Valuation Secretariat in order to present the applications to the Valuation Committee, and then executive procedures will be taken based on the provisions of the laws and applicable regulations.
